NEW DELHI: Citizens who need to in finding out if their telephones are under surveillance can seek such knowledge from the Telecom Regulatory Authority of India (Trai) under the RTI Act.

In a transparency-friendly ruling, the Delhi prime court docket has held that Trai will have to furnish knowledge on surveillance or tracking of an applicant’s telephone by means of any company since it has the legal power to acquire such info from a telecom service provider.

“If a public authority has a proper and is entitled to get admission to knowledge from a personal frame, under every other regulation, it's ‘knowledge’ as defined in Section 2 (f) of the RTI Act. The ruling came on a plea filed by means of attorney Kabir Shankar Bose. Justice Kait rejected the claim of Trai that it had no power to name knowledge from the non-public frame, i.e. Vodafone India in this case, mentioning that the regulator was regulating telecom products and services in India.

In September, the Central Information Commission (CIC) had requested Trai to offer Bose with the guidelines after taking it from Vodafone. Vodafone, alternatively, sought exemption from disclosure at the attorney’s RTI plea, claiming itself to be a personal organisation and no longer a ‘public authority’ as defined under the RTI Act.

Trai maintained that the guidelines sought by means of Bose was no longer part of record with it and on that ground alone it was no longer required to furnish the guidelines under any regulation or rules. The RTI Act didn't forged a duty upon Trai to collect such non-available knowledge and then furnish it to an applicant. The HC countered that ‘knowledge comprises in its ambit the guidelines on the subject of any personal frame, which can also be assessed by means of public authority under any regulation in the intervening time in drive’.
