Fertility clinic takes ex-CEO to court, alleges data theft, staff poaching

GURUGRAM: A popular city-based fertility hospital has moved court towards its former chief government officer (CEO), alleging that he helped a rival company arrange its centre in Delhi, later joined that firm and poached lots of its employees.
Bourn Hall International India Private Ltd, through Deepak Singla — an authorized consultant of the corporate — has approached the court towards its former CEO Gaurav Malhotra and rival firm Medicover Healthcare Private Ltd for inflicting critical monetary and reputational harm to the corporate and its employees.

Singla alleged in his criticism, which has now been registered as an FIR at the Sector 40 police station, that “it has been printed that Malhotra had begun talks with Medicover Group of Companies” whilst he used to be still employed at Bourn Hall.

The company has raised serious allegations towards Malhotra, which include “dishonestly helping Medicover in putting in its centre in India, diverting the petitioner’s funds, poaching the petitioner’s employees who have since joined Medicover, critical mismanagement of Bourn Hall’s budget through approving obviously bogus monetary transactions and payments, and falsification of the petitioner’s accounts.

Malhotra has also been accused of the usage of the corporate’s funds for reserving the domain title of the rival company, according to the FIR.

Another employee of the corporate, who joined Medicover, has also been accused of stealing the data of Bourn Hall. According to the complainant, information like “Lessons from Bourn Hall Clinic” and “Team members for Medicover Centre” have been retrieved through the corporate officials from the computer returned through Malhotra when he give up. One of those information allegedly accommodates the title of Dr Sweta Gupta — the then employee of Bourn Hall — who has been known as the “candidate for medical director” at Medicover.

The company, Medicover, has also been accused of fixing Bourn Hall’s address on Google maps to its personal address in Panchsheel Park, Delhi. “When customers of Google maps would type in “Bourn Hall Clinic Delhi” as the hunt key word, they have been shown “Panchsheel Park” as the address and make contact with main points of Medicover hospital towards that of Bourn Hall,” alleged the complainant.


Other charges levelled towards Malhotra include excessive payments to positive service providers without any clarification. “The monthly retainership of 1 dealer, Bhagwan Jha and Associates, who is now found to have been providing consultancy to the accused had increased from Rs. 60,000 to an amount between Rs 2 lakh and 2.6 lakh per thirty days without any rationale or documentation to reinforce such build up by any means,” the criticism charged. Acting at the court’s order, an FIR used to be registered towards Malhotra on February 28.


Denying the allegations, Malhotra said, “We have increased the trade (of Bourn Hall) from Rs 1.5crore to round Rs 30 crore in 3 years. We have been then stressed to do unethical practices like sending couples for sex variety to Dubai, which we refused because it used to be towards our ethics. This is a case of professional jealousy the place they have got now not been able to do just right trade due to deficient trade practices,” he said.


“The FIR has been filed with a malafide intent of looking to extort cash through threatening and intimidating the ex-employees. Medicover has completed extremely well in remaining two years and that reflects the sturdy management capacity. They are looking to malign Medicover due to professional jealousy...” he alleged.
